$1,750,000.00 Civil Rights Settlement for Widow of Undercover Officer Killed by Fellow Policeman

$5 million verdict for child who died from liver damage caused by Tylenol

Philadelphia jury awards Raynes McCarty client $950,000.00 for eye injuries caused by defective plastic flying disc.
Our client’s eye was lacerated when a shard of plastic flew off from a splintering and broken flying disc. Our client saw the disc sitting on the floor of his children’s playroom and noticed it was partially fractured with two small pieces missing. He picked it up, took it to the trash receptacle and flexed it slightly to fit it in the opening. As he flexed it, a shard of plastic shot into his eye.
On August 12, 2008, after a two day trial in the Philadelphia County Court of Common Pleas, a jury awarded plaintiffs $950,000.00 on the product safety claim against Endeavor Molded Plastics, the manufacturer of the flying disc. With delay damages, the verdict has been increased to $1,048,630.83.
Stephen Raynes proved that the disc was unsafe because it was made from a highly brittle and stiff plastic, polypropylene, which was known to shatter like glass. Attorney Raynes presented expert testimony that the disc should have been made of polyethylene, a highly flexible plastic that costs approximately the same amount.
Plaintiff underwent emergency surgery to repair the lacerations in his eye and remove the damaged lens, as well as a follow up surgery to implant a lens. Plaintiff has a permanent loss of visual acuity and peripheral vision, and experiences light sensitivity and glare. He will need to undergo further surgery to remove scar tissue, and he is at risk for further complications.
Defendant presented a biomechanical expert who testified that the shard of plastic from the flying disc could not have caused plaintiff’s injuries, based on the dimensions of the shard and the configuration of the injury. This opinion was in large part based on the expert’s misunderstanding that the injury did not involve a full-thickness corneal laceration. But plaintiff’s treating ophthalmologist, who performed the emergency surgery on him the night of his injury, confirmed that the plastic shard fully perforated through the cornea. The jury rejected the defense expert’s opinions.
Defendant also argued that it could not be held liable because disposing of a flying disc was not an intended use. Mr. Raynes convinced the jury that bending the flying disc slightly was an intended and foreseeable use.
